AI Feature Terms

These AI Feature Terms supplement the Terms of Use and apply only when an Organization enables, accesses, or uses an artificial-intelligence or machine-learning feature provided through the Service (an "AI Feature"). The Organization using an AI Feature is the "Customer" for these AI Feature Terms.

By enabling or using an AI Feature, Customer agrees to these AI Feature Terms. If these AI Feature Terms conflict with the Terms of Use regarding an AI Feature, these AI Feature Terms control.

Optional features

AI Features are optional and operate only when Customer enables or requests them. Comitium may add, change, restrict, suspend, or discontinue an AI Feature at any time. AI Features are not subject to a service-level commitment unless Comitium expressly agrees otherwise in writing.

Inputs, outputs, and permitted processing

Customer retains the rights it has in information submitted to an AI Feature ("Input"). Customer grants Comitium the limited rights needed to process and transmit Input and generate results ("Output") for Customer through the AI Feature.

Customer represents that it has all rights, lawful bases, notices, and consents needed for the Input and requested processing. As between Customer and Comitium, Customer may use Output for its internal recruiting activities to the extent permitted by law. Comitium does not claim ownership of Customer's Input or Output.

Comitium may use subprocessors identified in the Data Processing Agreement to provide AI Features. Customer Personal Data is processed under that agreement. Comitium does not use private recruitment data to train general-purpose AI models.

Customer responsibilities

Customer is solely responsible for:

  • deciding whether and how to use an AI Feature;
  • configuring lawful and job-related criteria, prompts, and instructions;
  • providing required notices, choices, and consents to candidates and other affected people;
  • evaluating whether its use complies with employment, discrimination, privacy, AI, and other applicable law;
  • reviewing and verifying Output, relevant source material, and the suitability of Output for its intended purpose; and
  • making every recruiting, employment, and hiring decision through appropriately qualified human reviewers.

Customer must not use Output as the sole basis for a decision that produces legal or similarly significant effects for a candidate. Customer must not use an AI Feature to unlawfully discriminate, infer protected characteristics, intentionally solicit sensitive data unrelated to a legitimate job requirement, or violate another person's rights.

AI disclaimers

AI Features and Output are provided "as is" and "as available." Output is generated probabilistically and may be incomplete, inaccurate, outdated, biased, or unsuitable. Comitium does not warrant the accuracy, completeness, reliability, non-infringement, availability, or absence of bias of an AI Feature or Output.

Output is not a hiring instruction, legal advice, or a decision by Comitium. Comitium is not responsible for Customer's Input, criteria, reliance on Output, or recruiting and employment decisions.

Suspension and termination

Comitium may suspend or terminate access to an AI Feature, with or without notice, if it reasonably believes the use violates these AI Feature Terms, creates risk or liability, may harm another person, or must be restricted for legal, provider, security, or operational reasons.

Liability and indemnification

The disclaimers, limitation of liability, and indemnification provisions in the Terms of Use apply to these AI Feature Terms. Claims arising from AI Features are included in, and do not increase, the aggregate liability limit stated in the Terms of Use.

Changes and contact

Comitium may update these AI Feature Terms by publishing a revised version. Changes apply prospectively from the stated effective date, and additional notice will be provided where required by law. Continued use of an AI Feature after that date constitutes acceptance where permitted by law.
